Fetish.com is committed to providing Users with a safe and fair environment in order to find dates, share content and provide their services. In accordance with out General Terms and Conditions it is not permitted to upload unlawful content which infringes upon intellectual property rights. Users may only provide their own content and we encourage respectful approach to sharing material.

Guideline

It is prohibited to upload any content for which you do not have the intellectual property rights or authorization. Fetish.com is dedicated to providing users with a reliable platform for connecting with service providers and arranging real-life dates. This is why authenticity has a significant relevance to creating accounts, portraying yourself and uploading content, therefore, wrong profile information and the use of so-called fake images are strictly prohibited. Provided content has not only to be in line with legal requirements and our policies but also respect all intellectual property rights, including copyright and trademark.

Enforcement

We put big effort in empowering service providers and enforcing their copyrights. Each user owns the content which they chose to upload and display on the platform if it does not infringe with intellectual property rights. Fetish.com provides a digital text placed on all uploaded visual material (“watermark”) to help users in protecting their content. Uploads are also prechecked by our support team in order to identify obvious violations in cases visuals portraying well known people are used, and remove such.

Furthermore, you can contact our support team at support@fetish.com and submit a notice about another account using your content. We ask you to name the account and describe the material in question in order to ease the process of identification and removal. Notifications on content of which you are not the owner or do not have authority to act on the owner´s behalf can still be submitted with a substantially statement to dataprotection@fetish.com. This note has to include:

• description of the material you believe to have been infringed;
• identification of the content on the platform to allow to locate it (username, description);
• your information and preferred way for us to be able to contact you;
• a statement that you have a good faith belief that use of the copyrighted content is not authorized by the right´s owner.

It must also be noted that uploading extern content may be justified by fair use, fair dealing or other exceptions to copyright laws, which results in the need of examination of every individual case.

Consequences in violation cases

All unlawfully used content will be removed from the platform, the accounts will be blocked, and the user will be asked to undergo a verification process. You can also file a complaint with your competent police department and we assure our full support if the authorities reach out to us.

As an EU-based creator you can file a complaint at the small claims court that works across all EU countries and therefore make a cross-border claim. You can find more information following the link: European Small Claims Procedure.
